Joint Statement to address domestic violence against women
The signing of this Joint Statement is the first activity within the "Human Rights" dialogue, in the top-down modality, resulting from high-level political dialogues, and consists of bringing justice to women, especially when it concerns to domestic violence crimes.
The objective of the project, approved within the Sector Dialogues Support Facility, is to replicate and disseminate good practices, at local and international scale, to address domestic violence and gender-based crimes. The project foresees a mission in which authorities and technicians participate on the issue by visiting Europe (Italy, Lithuania and Portugal), as well as the reception of European experts in Brazil for working meetings and an international seminar to disseminate project outcomes, among which a study to be performed by European and Brazilian experts contracted within the project.
Activities also involve the exchange of experiences, in a qualified environment, in the field of domestic violence, with emphasis on two actions developed by the CNMP. The first refers to the "femicide seal". With it, the CNMP succeeded in drastically reducing femicide inquiries in Brazil, by prosecuting thousands of criminal actions. The second is the National Register of Domestic and Family Violence (CNVD) made by the CNMP jointly with the Public Ministries of all Brazilian states. It consists of the creation of a "Big Data" of the Brazilian scene regarding domestic violence and has information about the number of crimes committed, the places where they occurred, the profile of the perpetrator, the data of the victim, and the stage of the investigation.
"The inspiration to seek experiences across borders was a consequence of the success of initiatives coordinated by the CNMP, as in the case of the 'femicide target' and also the CNVD (National Register of Domestic Violence)," explains counselor Valter Shuenquener.
Since the implementation of the 'femicide target', the number of police investigations on such a heinous crime in Brazil has halved. The National Registry of Domestic and Family Violence, foreseen in the Maria da Penha Law (Law 11,340 / 2006), began operating in 2016 within the framework of the CNMP, in cooperation with other 27 units of the Brazilian Public Ministry.
Maria da Penha Law (11,340 / 20016) - completes 11 years of existence. It is the main legislative tool addressing domestic and family violence against women in Brazil. Apart from physical violence, it encompasses sexual, psychological, moral, and property abuse between the victim and the offender - who does not necessarily have to be a spouse, but just have some kind of affective relationship. The name of the law is a tribute to the biopharmaceutical woman, from the State of Ceará, Maria da Penha, who fought for 20 years to see her attacker arrested. Maria da Penha suffered two homicide attempts by her husband and the first one - a shot in the back while she was sleeping - left her with paraplegia. After appealing to Justice, NGOs and, finally, the Inter-American Commission on Human Rights (IACHR-OAS), Penha was able to have her aggressor, Marco Antonio Herredia Viveros, condemned. It is essential that women seek support from the competent authorities and continue to report the various types of violence that they suffer.
