Federal government civil servants, national and international experts and representatives of civil society organisations (CSOs) participated in the 2nd International Seminar on the Regulatory Framework of Civil Society, held in Brasília between 21 and 23 May. This event was sponsored by EU-Brazil Sector Dialogues Support Facility (coordinated by the Ministry of Planning, Budget and Management and the EU Delegation in Brazil - Delbra) and aimed to discuss diffusion and improvement tools for legal instruments and public policies, and intervention strategies for the construction of the regulatory framework, as well as further knowledge in cooperation and regulation mechanisms governing CSOs in Brazil and Europe.
Participating in official opening of the event, the head of Delbra’s Development and Cooperation Department, Mr Jerome Poussielgue, highlighted the importance of CSOs in the development of both Brazil and Europe. "A civil society empowered with the means for action is essential because it contributes to more effective policies, inclusive growth and democracies that are more open and stronger", he said.
Congress representative Mrs Maria do Rosario Nunes, elected through the Workers’ Party in a Rio Grande do Sul constituency and who until April this year held the position of Head of the Human Rights Secretariat of the Presidency (SDH / PR), stressed that the Regulatory Framework of Civil Society Organisations (MROSC), when in force, will enable society to better address the criminalisation of social movements. "Today, there are various movements being cast into illegality due to the lack of clarity in the rules. With the framework, we hope to grant legal security in the relationship between the state and civil society and greater transparency and autonomy for such organisations", she said.
The special advisor to the General Secretariat of the Presidency (SGP/PR), Ms Lais de Figueiredo Lopes, stressed that since the completion of the first MROSC seminar in 2011, a lot of progress has been made towards the creation of the regulatory framework. "The proposals from the previous event generated a very inspiring action plan. We have never been this close to multiplying partnerships between the state and society", she said. "It is important to foster autonomous organisations that can legitimately criticise the state even while being sponsored by it", she added.
During the three-day seminar, several topics related to MROSC were discussed, including: an assessment of the agenda; contracting; the sustainability of CSOs; transparency and social participation; experiences and guidelines for partnerships between the state and CSOs; freedom of association, peaceful assembly and demonstration; the sports incentive law; certification of CSOs; and future scenarios for civil society organisations in Brazil.
About MROSC
Currently pending before the House of Representatives, the MROSC aims to regulate relations between the government and organisations such as foundations, associations and public interest organisations (Ocips), among others. The work to create the MROSC began in 2010 and involved more than 50,000 organisations, social movements and civil society organisational networks.
According to the General Secretariat of the Presidency, in Brazil there are about 300,000 civil society organisations, mostly in the areas of education and health care. With MROSC, clear parameters will be created to regulate the relationship between these organisations and the public authorities and ensure they have legal security and political and financial autonomy.
At the closure of the Digital Participation Arena, which included among other events the 2nd Seminar on the MROSC, President Dilma Rousseff called for the approval of the regulatory framework. "Upholding social participation is upholding democracy. I will work to get the Regulatory Framework passed by Congress", she said. Ms Rousseff also signed a decree at the event that launched the National Policy for Social Participation, which aims to strengthen the role of civil society in representative bodies such as national, state and municipal councils.
