The new Brazilian antitrust law (Act 12.529/2011), passed in November 2011, was the subject of an international workshop held in Brasilia by the Administrative Council for Economic Defense (Cade), with support from the EU - Brazil Sector Dialogues Support Facility. At the event, held between May 20 and 22, experts from 12 European countries also presented their national models of antitrust legislation.
Both Brazilian and European participants had the chance to learn about the main changes brought about by the new Brazilian legislation. One of the biggest was the unification of the antitrust authorities, which were once decentralised and are now convened at Cade. This new model has brought Brazil closer to the US and European models, in line with international best practices. "In such a context, the workshop helped further the dialogue with the European Union, which has already been very enriching for some time," says Mr. Paulo Burnier da Silveira, head of Cades international advisory board.
During the event, discussions were also held on international merger control and international cooperation regarding anticompetitive conduct (especially cartels), besides the rounds of presentations by the European guests on the antitrust systems in their countries. Finally, participants were able to watch a trial session with simultaneous translation.
"The result was the best possible and we had very positive feedback from the Europeans," says Mr. Burnier. With the closure of this stage, he says that Cade is awaiting future calls from the Sector Dialogues Support Facility, so it can request new exchange activities. "We are strengthening a trusting relationship with the competition authorities involved, which is essential in our area," he notes.
